HauzHunter - Terms of Service

1. Agreement to Terms

Welcome to HauzHunter! These Terms of Service ("Terms") constitute a legally binding agreement between you and Kindertec Co Ltd ("HauzHunter," "we," "our," or "us") governing your use of the HauzHunter mobile application (the "App") and related services (collectively, the "Services").

By creating an account or using HauzHunter, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

1.1 Eligibility

You must meet the following requirements to use HauzHunter:

  • Age: You must be at least 18 years old
  • Legal Capacity: You must have the legal capacity to enter into binding contracts
  • Location: You must be located in Kenya or a country where our Services are available
  • Phone Number: You must have a valid Kenyan mobile phone number (+254)

2. Description of Services

HauzHunter is a marketplace platform connecting:

  • Seekers: Individuals looking for rental properties who wish to hire professional house hunters
  • Hunters: Verified professionals who help seekers find suitable rental properties

What HauzHunter Is NOT:

  • We are NOT a real estate agency - we do not own or manage properties
  • We are NOT a property listing service - we do not verify property details
  • We are NOT an employment platform - hunters are independent contractors
  • We are NOT a guarantor - we do not guarantee seeker satisfaction or hunter earnings

3. Account Registration and Security

To use HauzHunter, you must:

  • Provide a valid Kenyan phone number (+254)
  • Verify your number via OTP (One-Time Password)
  • Select your role: Seeker or Hunter
  • For Hunters: Complete your profile (name, coverage areas, optional photo/bio)

You are solely responsible for maintaining the confidentiality of your account and OTP codes.

4. User Roles and Responsibilities

4.1 Seeker Responsibilities

As a Seeker, you agree to:

  • Provide accurate hunt details (budget, preferences, requirements)
  • Pay upfront via M-Pesa before hunt activation
  • Communicate respectfully with hunters
  • Confirm satisfaction or raise disputes promptly
  • Provide honest, fair reviews
  • Not abuse the dispute system

4.2 Hunter Responsibilities

As a Hunter, you agree to:

  • Only add areas where you genuinely have knowledge and access
  • Accept hunts in good faith and fulfill them
  • Provide quality service matching seeker requirements
  • Maintain professional communication
  • Be honest - no fake properties or misleading information
  • Accept payment terms (escrow system and platform commission)

Hunter Code of Conduct:

  • No harassment, discrimination, or abusive behavior
  • No requesting side payments outside the platform
  • No collusion with landlords for undisclosed kickbacks
  • No poaching seekers to bypass platform fees

5. Pricing, Payments, and Fees

5.1 Seeker Fees

  • Hunt fees are calculated based on the number of coverage areas selected
  • A base fee applies for the first area, with incremental fees for additional areas
  • Maximum of 10 coverage areas per hunt
  • Total cost is displayed before payment confirmation

5.2 Payment Method and Escrow System

All payments are processed via M-Pesa. When a seeker pays, the money is held in escrow and released when:

  • The hunter marks the hunt complete AND the seeker confirms satisfaction, OR
  • 30 days pass without activity (auto-completion), OR
  • An admin resolves a dispute in favor of the hunter

5.3 Hunter Earnings and Commission

  • HauzHunter retains a platform commission from each hunt fee
  • Hunters receive the majority share of the hunt fee upon successful completion
  • Earnings are credited to an in-app wallet
  • Payouts processed within 24 hours

6. Hunt Lifecycle

1. Hunt Creation:

Seeker creates hunt with details and completes M-Pesa payment

2. Hunter Assignment:

Our algorithm notifies hunters covering the target areas; first to accept is assigned

3. Active Hunt:

Hunter searches for properties and shares options with seeker

4. Completion:

Hunter marks complete; seeker confirms or raises dispute

5. Auto-Completion:

If 30 days pass without seeker action, hunt auto-completes and hunter is paid

7. Disputes and Resolution

Seekers may raise disputes if hunters provide inadequate service, are unresponsive, or engage in misconduct.

Dispute Process:

  1. Seeker submits dispute with evidence
  2. Hunter responds with their perspective
  3. Admin reviews all evidence (5-7 business days)
  4. Admin makes binding decision (full payment, full refund, or partial)

Admin decisions are final and binding. Repeated abuse of the dispute system may result in account suspension.

8. Cancellations and Refunds

  • Before Hunter Assignment: Free cancellation with full refund (100%)
  • After Hunter Assignment: Requires dispute process; refund depends on admin decision
  • After Confirmation: Payment is final and non-refundable
  • Refund Method: All refunds via M-Pesa within 5-7 business days

9. Prohibited Conduct

You agree NOT to:

  • Create fake accounts or impersonate others
  • Submit false hunt requests or disputes
  • Harass, threaten, or abuse other users
  • Bypass platform fees by taking transactions off-platform
  • Use automated scripts, bots, or scraping tools
  • Engage in illegal activity or money laundering

Violation may result in account suspension, termination, forfeiture of earnings, and legal action.

10. Disclaimers and Limitations of Liability

HAUZHUNTER IS PROVIDED "AS-IS"

  • We do NOT verify property information accuracy
  • We do NOT guarantee uninterrupted or error-free service
  • Hunters are independent contractors, not our employees
  • We are NOT responsible for disputes between seekers and hunters
  • We are NOT liable for fraudulent landlords or rental scams

Maximum Liability: Our total liability to you shall not exceed the amount you paid to HauzHunter in the 6 months preceding the claim.

11. Termination

You may terminate your account anytime by emailing hauzhunter@kindertec.co.ke. We may suspend or terminate your account immediately for Terms violations, fraud, harassment, or as required by law.

12. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya, located in Nairobi.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you via push notification or email. Significant changes will be announced at least 30 days before taking effect. Your continued use after changes constitutes acceptance.
